Fuel 1 LLC Affiliate Program Terms and Conditions

These Terms and Conditions ("Agreement") constitute a binding agreement between you ("Affiliate", "you", or "your") and Fuel 1 LLC ("we", "us", or "our") regarding your participation in the Fuel 1 Affiliate Program ("Program").
By enrolling in the Program, you acknowledge and agree to the following terms:
1. Affiliate Enrollment
- To join the Program, you must submit an application through our platform.
- We reserve the right to approve or reject any application at our sole discretion.
- By applying, you represent that you are at least 18 years old and have the legal capacity to enter into this Agreement.
2. Program Overview
- Affiliates promote Fuel 1 LLC services through unique affiliate links provided via our affiliate management platform, Rewardful.
- You will earn commissions based on qualifying referrals that convert to paying customers under the terms outlined below.
3. Commissions
- Commission Rate: Affiliates earn a 30% recurring commission on revenue generated by referred customers for as long as their accounts remain active, unless the Program is discontinued or the Affiliate's participation is terminated.
- Qualifying Referrals: Commissions are earned only when a referred customer:
- Signs up through your unique affiliate link.
- Remains an active, paying customer beyond the 30-day refund window.
- Is not flagged as fraudulent, self-referred, or otherwise ineligible.
- Disqualifications: Commissions will not be paid for:
- Referrals made to yourself, your employer, or entities you directly own or control.
- Accounts refunded, canceled, or disputed within the first 30 days of payment.
- Referrals flagged for fraudulent, suspicious, or unethical activity as determined by our compliance team.
- Referrals generated from domains, platforms, or traffic sources that are flagged as unsafe or harmful by third-party monitoring services (e.g., Google Safe Browsing).
- Payout Threshold: Commissions are paid out once your balance reaches a minimum of $25.
4. Payment Terms
- Payment Frequency: Payments are processed monthly, within 30 days of the end of the previous month.
- Payment Method: All payments are made via PayPal. Affiliates must provide a valid PayPal account to receive commissions.
- Refund Adjustments: If a referred customer requests a refund, any associated commission will be deducted from the next payout.
- Tax Responsibility: Affiliates are responsible for reporting and paying any applicable taxes on earnings received through the Program.
5. Cookie Duration
- Referral Tracking: Our platform tracks referrals using cookies, which remain active for 30 days after a potential customer clicks your affiliate link.
- Expired Cookies: If a customer signs up after the cookie expires or does not use your affiliate link, you will not receive a commission.
6. Prohibited Activities
Affiliates must adhere to ethical and legal promotional practices. The following actions are prohibited:
- Misleading Advertising
- Spam
- Trademark Misuse
- Self-Referrals
- Inappropriate Content
- Fraudulent Referrals
- Unethical Traffic Sources
Violations of these terms will result in immediate termination of your participation in the Program and forfeiture of any unpaid commissions.
7. Affiliate Proof of Compliance
- Upon request, affiliates must provide documentation of promotional activities.
8. Termination
- You may terminate your participation at any time by notifying us.
- We reserve the right to suspend or terminate your participation at our discretion.
9. Dispute Resolution
- Governing Law: Florida, United States.
- Arbitration through JAMS Comprehensive Arbitration Rules & Procedures.
- Class Action Waiver: Affiliates waive their right to participate in any class action.
10. Monitoring and Auditing
Fuel 1 LLC reserves the right to monitor affiliate activity for fraud or unethical behavior.
11. Indemnification
You agree to indemnify and hold harmless Fuel 1 LLC from any claims arising out of your participation in the Program.
12. Limitation of Liability
Fuel 1 LLC will not be liable for indirect, incidental, or consequential damages.
13. Miscellaneous
- This Agreement constitutes the entire agreement.
- No Waiver.
- Severability.
